Please Note:
Every Warranty Deed must be accompanied by a Georgia Real Estate
Transfer Tax Form (PT-61) that has been properly filled out and signed. The
taxation rate on the value of the property conveyed, less the amount of any
loan assumed, is $1.00 per $1,000.00 of value, plus $0.10 per each additional,
or any portion of $100.00. For example on a sale that had the sales price
(consideration) of $135,635 , and no loan was assumed; the tax due would be
$135.70. and:
Security Deeds that have a term of 3 years or more are considered
"long term" and therefore are subject to Intangible Tax. The taxation rate is
$1.50 per $500.00 principle amount. For example; a security deed has a
principle amount of $1,000; the tax due would be $3.00. For a principle amount
of $1,001.00; the tax would be $4.50.
Security Deed must state a maturity date for the purpose of determining the
taxability of the document
